Jonathan Isau Hernandez, 25, of Port Arthur, was arrested by the Montgomery County Sheriff’s Office on Feb. 11, pursuant to an active warrant from Jefferson County detailing three charges of aggravated sexual assault of a child stemming from a 2017 allegation and victim interview.
According to public record, a Jefferson County grand jury indicted Hernandez on July 22 on the first-degree felony charges of aggravated sexual assault of a child.
According to a probable cause affidavit dated April 21, 2017, a child the age of seven years old and related to the accused, who was 17 at the time, was interviewed at the Garth House. The PAPD case details that the complainant and his nine-year-old sibling outcried to their mother that Hernandez had shown both of them pornographic material and acted inappropriately with them.
The child went on to describe oral sexual assault by the accused the year prior, when the victim was seven years old. The child said Hernandez would beat him and lock him up, and described being victim to penetrative sexual assault by Hernandez on multiple occasions.
In Texas, there is no criminal statute of limitation for the aggravated sexual assault of a child, allowing prosecution regardless of the number of years that have passed.
