ORDINANCE NO. 25-007


 

AN ORDINANCE OF THE CITY OF BEAUMONT, TEXAS, PROVIDING FOR A GENERAL ELECTION TO BE HELD ON THE 3RD OF MAY, 2025 FOR THE PURPOSE OF ELECTING A MAYOR, TWO (2) COUNCILMEMBERS-AT-LARGE AND FOUR (4) WARD COUNCILMEMBERS (WARDS I, II, III, AND IV) AND; PROVIDING THE FORM OF THE BALLOT AT SUCH ELECTION; DIRECTING THE GIVING OF NOTICE OF SUCH ELECTION; PROVIDING FOR A JOINT ELECTION WITH THE BEAUMONT INDEPENDENT SCHOOL DISTRICT AND PORT OF BEAUMONT; AND CONTAINING OTHER PROVISIONS RELATING TO THE SUBJECT AND APPROVING A RUNOFF ELECTION IF NECESSARY ON THE 7TH DAY OF JUNE, 2025.


 

BE IT ORDAINED BY THE CITY OF BEAUMONT:


 

Section 1.

In accordance with the City Charter, the Constitution, and general laws of the State of Texas, a general municipal election is hereby called and ordered for the first Saturday in May 2025, the same being the 3rd day of said month. At said election all qualified voters residing within the corporate limits of the City of Beaumont may vote for the purpose of electing a Mayor, two (2) Councilmembers-At-Large, and Councilmembers to Wards I, II, III, and IV for full terms.


 

Section 2.

No person’s name shall be placed upon the official ballot as a candidate for any of the above-mentioned positions unless such person has filed his or her sworn application, as provided by Section 141.031, Section 143.004, and Section 143.007 of the Texas Election Code, with the City Clerk, not later than five o’clock (5:00) p.m. on the seventy-eighth (78th) day before the date of such election.  The City Clerk shall note on the face of each such application the date and time of its filing.  A declaration of write-in candidacy must be filed with the City Clerk as provided by Section 146.054 of the Texas Election Code, not later than five o’clock (5:00) p.m. of the seventy-fourth (74th) day before Election Day.


 

Section 3.

Said election shall be held jointly with the Beaumont Independent School District and the Port of Beaumont in accordance with Chapter 271 of the Texas Election Code. The Jefferson County Clerk will coordinate, supervise, and handle all aspects of administering said joint election in accordance with the provisions of the Texas Election Code.


 

Section 4.

Legally qualified voters residing within the corporate limits of the City of Beaumont shall be entitled to a vote at said election for the respective candidate(s) and other matters that may appear on the ballot.


 

Section 5.

The notice and order of said election shall be given by posting and publishing said notice and order as provided by the Texas Election Code.


 

Section 6.

An electronic voting system, as described by Title 8 of the Texas Election Code, shall be used for said election.


 

Section 7.

The following are appointed officers of said election to serve at the Central Counting Station, which is hereby established at the Central Counting Station, 7963 Viterbro Road, Nederland, Texas; Central Counting Station Manager, Wayne Ozio, Tabulation Supervisor, Jeff Ross, and Assistant Tabulation Supervisor, Scott LeBlanc.


 

Section 8.

Procuring, allocating, and distributing election supplies shall be prepared in accordance with Title 5 of the Texas Election Code.


 

Section 9.

Roxanne Hellberg, County Clerk of Jefferson County is hereby appointed Clerk for early voting pursuant to Chapter 83 Subchapter B of the Texas Election Code, and if approved, said appointment being without additional compensation.

Box 1151, Beaumont, Texas, 77704-1151.  The County Clerk shall keep said office open for at least eight (8) hours between 8:00 a.m. and 5:00 p.m., on each day for early voting or an official State Holiday beginning on the twelfth (12th) day through the fourth (4th) day preceding the date of such election; provided, however, except as authorized by Sections 85.005 (a) and (d), Texas Election Code, said County Clerk shall not permit anyone to vote early by personal appearance on any day or time not designated herein for early voting and under no circumstances shall she permit anyone to vote early by personal appearance at any time when her office is not open to the public for early voting purposes.

Section 10.

Early votes by personal appearance and by mail shall be counted by an Early Voting Ballot Board consisting of a presiding judge and (5) five clerks, the County Clerk may authorize as many additional clerks as are deemed necessary.  Early votes shall be canvassed and returned by the Early Voting Ballot Board to the Central Counting Station by 7:00 p.m. on Election Day.


 

Section 11.

If any person or persons appointed herein do not appear, are unable to perform their duties, or fail to perform their duties, the County Clerk shall have the discretion and authority to appoint any substitute personnel to fill the position(s).


 

Section 12.

The order in which the names of the candidates are to be printed on the ballot shall be determined by a drawing by the City Clerk, as provided by Section 52.094 of the Texas Election Code.  The City Clerk shall post a notice in the office of the City Clerk, 801 Main St., Suite 125, Beaumont, Texas, 77701 at least seventy-two (72) hours prior to the date on which the drawing is to be held, of the date, hour and place of the drawing, and shall also give personal notice to each candidate by: written notice, mailed to the address stated on the candidates application for a place on the ballot, not later than the fourth day before the date of the drawing, or by telephone, or email address if provided on the candidates application for a place on the ballot.  Each candidate affected by the drawing is entitled to be present or have a representative present at the drawing and shall have a right to observe the drawing.


 

Section 13.

If any section, subsection, sentence, clause, or phrase of this ordinance, or the application of same to a particular set of persons or circumstances, should for any reason be held to be invalid or adjudged unconstitutional by a court of competent jurisdiction, such invalidity shall not affect the remaining portions of this ordinance, and to such end the various portions and provisions of this ordinance are declared to be severable; and the City Council of the City of Beaumont, Texas, declares it would have passed each and every part of the same notwithstanding the omission of any such part thus declared to be invalid or unconstitutional, or whether there be one or more parts.


 

Section 14.

That all ordinances or parts of ordinances inconsistent or in conflict herewith are, to the extent of such inconsistency or conflict, hereby repealed.


 

The meeting at which this ordinance was approved was in all things conducted in strict compliance with the Texas Open Meetings Act, Texas Government Code, Chapter 551.

ASI ORDENADO POR LA CIUDAD DE BEAUMONT:


 

Sección 1

De acuerdo al estatuto de la ciudad, la constitución, y las leyes generales del Estado de Texas, y por este medio se ha llamado y ordenado a una elección general municipal para el primer sábado de Mayo 2023, que sería el día 03 de dicho mes, elección en la que todos los votantes calificados que residan dentro de los limites corporativos de la Ciudad de Beaumont podrán votar con el propósito de elegir a un Alcalde, Concejales para los Distritos I, II, III and IV y dos (2) Concejales para un término completo.


 

Sección 2

No se colocara el nombre de ninguna persona en la papeleta de votación official como candidato para alguna de las posiciones arriba mencionadas a menos que dicha persona haya presentado la declaración de su solicitud, así estipulado por la Sección 141.031, Sección 143.004, y Sección 143.007 del Código Electoral de Texas, con la oficina de la Secretaria Municipal, no después de las cinco en punto (5:00) p.m. en el día setenta y ocho (78) antes de la fecha de dicha elección. La Secretaria Municipal de la ciudad deberá anotar en la cara de cada solicitud, la fecha y la hora de presentación. Una declaración de candidatura por escrito debe ser presentada a la Secretaria Municipal como lo estipula la Sección 146.054 del Código Electoral de Texas, a más tardar de las cinco en punto (5:00) p.m. en el día setenta y cuatro (74) antes del día de la elección.


 

Sección 3

Sección 10

Los votos anticipados deben ser analizados y retornados por el Comité de Votación Anticipada a la Estación Central de Conteo de Votos para las 7:00 p.m. en el día de Elección.


 

Sección 11

Si cualquier persona o personas designadas no aparecen, o son incapaces de realizar sus deberes, o fallan realizar sus deberes, la Secretaria del Condado tendrá la discreción y autoridad para designar a un substituto empleado para llenar la(s) posición(es).


 

Sección 12

Si alguna sección, subsección, frase, cláusula de esta ordenanza, o esta solicitud del mismo grupo particular de personas o circunstancias, por cualquier razón se considerara invalido o adjudicado inconstitucional por la competente jurisdicción de la corte, tal invalidez no afectara las porciones restantes de esta ordenanza, y para tal fin las diversas porciones y provisiones de esta ordenanza son declaradas ser separables; y el Ayuntamiento de la Ciudad de Beaumont, Texas, declare que podría haber pasado cada una y todas las partes de la misma a pesar de la omisión de cualquier porción declarada de ser invalida o inconstitucional, o sea que hay una o más porciones.


 

Sección 14

Todas las ordenanzas o partes de ordenanzas inconsistentes o en conflicto con la presente son, en la medida de tal inconsistencia o conflicto, por la presente, derogadas.


 

La junta en cual esta ordenanza fue aprobada fue en todas las cosas realizadas en estricto cumplimiento con la Ley de Reuniones Abiertas de Texas, Código de Gobierno de Texas, y Capitulo 551.

AND FY 2025 ACTION PLAN


 

The City of Beaumont has prepared a draft FY 2025-2029 Consolidated Plan and FY 2025 Annual Action Plan and summary that identify how the city will use federal resources to meet priority community needs. The 2025-2029 Consolidated Plan consolidates the application, planning, and allocation processes for federal funds received from the U.S. Department of Housing and Urban Development (HUD) for the administration of Community Development Block Grant Program (CDBG) and HOME Investment Partnerships Program (HOME). For FY 2025, the City estimates to receive approximately $1,392,979 in CDBG funds and $535,472.20, based on FY 2024 award amounts.


 

The Plan was developed with information received through public stakeholder meetings, public hearings, and citizen participation coordinated by the Community Development Department, and includes comments received through Community Needs Assessment engagement efforts.


 

Priorities for funding in FY 2025-2029 Consolidated Plan are listed as follows:


 

Provide Decent, Safe Affordable Housing

Potential activities to address priority need: home repair programs, homeownership assistance, and activities that promote the development of affordable housing units


 

Create Suitable Living Environments

Potential activities to address priority need: infrastructure and public facility improvements, clearance and demolition programs, and safety enforcement activities


 

Provide Public Services for Low Moderate-Income Households

Potential activities to address priority need: Public service activities to address the needs of low-income households and special needs populations such as homeless populations, seniors, children, and other populations with special needs


 

The draft Consolidated Plan and summary will be available for public review and comment for thirty (30) days beginning on April 17, 2025, through May 20, 2025 at

the City’s Community Development Department CDBG/ Housing website: https://www.beaumonttexas.gov/233/CDBGHousing-Services.  A public hearing will be held to receive comments after which the city council may consider the adoption the FY 2025-2029 Consolidated Plan and FY 2025 Action Plan. All interested persons are invited to attend.


 

The hearing will be held on Tuesday, May 20, 2025, at 1:30 p.m. in Council Chambers, located on the 1st floor of City Hall, 801 Main Street, Beaumont, TX 77701. The meeting site is wheelchair accessible. Persons with disabilities who plan to attend this meeting and who may need auxiliary aids or services are requested to contact Kaltrina Minick at (409) 880-3777 at least one day prior to the meeting.


 

PUBLIC COMMENT:

Proposed use of Federal funds is outlined in the draft Consolidated Plan and Annual Action Plan and summary. HUD has not yet announced FY 2025 funding amounts for CDBG and HOME. Recommendations for all the grants were developed by City staff based on FY 2024 HUD funding amounts. All recommendations are subject to change based on actual FY 2025 HUD funding amounts.

La ciudad de Beaumont ha preparado un borrador del Plan Consolidado para el año fiscal 2025-2029 y del Plan de Acción Anual del año fiscal 2025, junto con un resumen, que identifica cómo la ciudad utilizará los recursos federales para satisfacer las necesidades prioritarias de la comunidad. El Plan Consolidado 2025-2029 consolida los procesos de solicitud, planificación y asignación de los fondos federales recibidos del Departamento de Vivienda y Desarrollo Urbano de los Estados Unidos (HUD) para la administración del Programa de Subvenciones en Bloque para el Desarrollo Comunitario (CDBG) y el Programa de Asociaciones de Inversión HOME (HOME). Para el año fiscal 2025, la Ciudad estima recibir aproximadamente $1,392,979 en fondos CDBG y $535,472.20, con base en los montos de adjudicación del año fiscal 2024.

Las prioridades de financiación del Plan Consolidado para el año fiscal 2025-2029 se enumeran a continuación:

El borrador del Plan Consolidado y su resumen estarán disponibles para revisión y comentarios del público durante treinta (30) días, a partir del 17 de abril de 2025 y hasta el 20 de mayo de 2025, en el sitio web del CDBG/Vivienda del Departamento de Desarrollo Comunitario de la Ciudad: https://www.beaumonttexas.gov/233/CDBGHousing-Services.  Se celebrará una

audiencia pública para recibir comentarios, tras la cual el ayuntamiento podrá considerar la adopción del Plan Consolidado para el año fiscal 2025-2029 y el Plan de Acción para el año fiscal 2025. Se invita a todos los interesados a asistir.

WHEREAS, on October 12, 2012, a certain Adjustable Rate Home Equity Conversion Deed of Trust (“Reverse Mortgage”) was executed by ROY A. HICKMAN, as mortgagor in favor of MORTGAGE ELECTRONIC REGISTRATION SYSTEMS, INC., AS BENEFICIARY, AS NOMINEE FOR URBAN FINANCIAL GROUP, INC., ITS SUCCESSORS AND ASSIGNS, as mortgagee and ALAN E. WHEREAS, the Reverse Mortgage was insured by the United States Secretary of Housing and Urban Development (the “Secretary”) pursuant to the National Housing Act for the purpose of providing single family housing; and

The sale will be held in Jefferson County, Texas at the following location: THE MOST NORTHERLY ENTRANCE OF THE NEWEST ADDITION TO THE COUNTY COURTHOUSE AND OPPOSITE THE MAIN ENTRANCE TO THE NEW COUNTY JAIL OR AS DESIGNATED BY THE COUNTY COMMISSIONER`S OFFICE or as designated by the County Commissioners Court.


 

The Secretary of Housing and Urban Development will bid $196,312.41.


 

There will be no proration of taxes, rents or other income or liabilities, except that the purchaser will pay, at or before closing, his prorate share of any real estate taxes that have been paid by the Secretary to the date of the foreclosure sale.


 

When making their bids, all bidders except the Secretary must submit a deposit totaling $19,631.24 in the form of a certified check or cashier’s check made out to the Secretary of HUD. A deposit need not accompany each oral bid. If the successful bid is oral, a deposit of $19,631.24 must be presented before the bidding is closed. The deposit is nonrefundable. The remainder of the purchase price must be delivered within 30 days of the sale or at such other time as the Secretary may determine for good cause shown, time being of the essence. This amount, like the bid deposits, must be delivered in the form of a certified or cashier’s check. If the Secretary is the highest bidder, he need not pay the bid amount in cash. The successful bidder will pay all conveying fees, all real estate and other taxes that are due on or after the delivery date of the remainder of the payment and all other costs associated with the transfer of title.  At the conclusion of the sale, the deposits of the unsuccessful bidders will be returned to them.


 

The Secretary may grant an extension of time within which to deliver the remainder of the payment. All extensions will be for 15-day increments for a fee of $500.00, paid in advance. The extension fee shall be in the form of a certified or cashier’s check made payable to the Secretary of HUD. If the high bidder closes the sale prior to the expiration of any extension period, the unused portion of the extension fee shall be applied toward the amount due.


 

If the high bidder is unable to close the sale within the required period, or within any extension of time granted by the Secretary, the high bidder may be required to forfeit the cash deposit or, at the election of the foreclosure commissioner after consultation with the HUD representative, will be liable to HUD for any costs incurred as a result of such failure. The Commissioner may, at the direction of the HUD representative, offer the property to the second highest bidder for an amount equal to the highest price offered by that bidder.


 

There is no right of redemption, or right of possession based upon a right of redemption, in the mortgagor or others subsequent to a foreclosure completed pursuant to the Act. Therefore, the Foreclosure Commissioner will issue a Deed to the purchaser(s) upon receipt of the entire purchase price in accordance with the terms of the sale as provided herein. HUD does not guarantee that the property will be vacant.


 

The scheduled foreclosure sale shall be cancelled or adjourned if it is established, by documented written application of the mortgagor to the Foreclosure Commissioner not less than 3 days before the date of sale, or otherwise, that the default or defaults upon which the foreclosure is based did not exist at the time of service of this notice of default and foreclosure sale, or all amounts due under the mortgage agreement are tendered to the Foreclosure Commissioner, in the form of a certified or cashier’s check payable to the Secretary of HUD, before public auction of the property is completed.


 

The amount that must be paid if the mortgage is to be paid in full prior the scheduled sale is $196,312.41, plus all other amounts that would be due under the mortgage agreement if payments under the mortgage had not been accelerated, advertising costs and postage expenses incurred in giving notice, mileage by the most reasonable road distance for posting notices and for the Foreclosure Commissioner’s attendance at the sale, reasonable and customary costs incurred for title and lien record searches, the necessary out-of- pocket costs incurred by the Foreclosure Commissioner for recording documents, a commission for the Foreclosure Commissioner, and all other costs incurred in connection with the foreclosure prior to reinstatement.
